***The Governor extended the rental moratorium for residential until June 30, 2021***
State Tenant and Landlord Resources
Local Residential Moratorium Information
The following is for informational purposes only. It is not intended to be legal advice. Please contact your personal attorney or legal aid resource for advice as to your particular situation.
On August 31, 2020, AB 3088 was signed into law, and as of October 1, 2020 is the only eviction moratorium program in place statewide. The law offers eviction protection through June 30, 2021. The text of the bill can be found here.
The key elements of AB 3088 are as follows: -landlords were required to send a special notice by September 30 to tenants with unpaid rents. That notice outlines tenants’ rights under this new law -in order to be covered by AB 3088, tenants must document income loss due to COVID, and must pay 25% of any rent due between September 1, 2020 and January 31, 2021 -evictions for non-payment of rent can go forward if they are non-COVID related -there is a specific State law based hardship declaration form that tenants must provide to landlords: https://www.tobenerlaw.com/wp-content/uploads/2020/09/Sample_AB3088_Declaration.docx
Repayment Provisions
For unpaid rent accrued from March 1, 2020 through August 31, 2020, due to COVID related losses, where the tenant has submitted the appropriate hardship declaration, the amount owed shall be converted to commercial debt and is collectible through small claims court rather than an Unlawful Detainer action -the Thousand Oaks eviction moratorium provides for a six-month payback period without penalties or interest. Under the provisions of AB 3088, that payback period would begin on March 1, 2021.
The moratorium would provide an affirmative defense in any action brought prior to that time.
-For unpaid rent accrued from September 1, 2020 through January 31, 2021 due to COVID related losses, where the tenant has submitted a hardship declaration for each month of unpaid rent, and pays, prior to January 31, 2021, at least 25% of all rent due from September 1, 2020 through January 31, 2021, the amount owed shall be converted to commercial debt and can be recovered through small claims court, but cannot be used as the basis for eviction.
As of February 1, 2021, normal Unlawful Detainer rules will apply
